2026 Mid-Year Update
At Miliband Water Law, 2026 has already proven to be a dynamic year in the first two quarters and what is now officially two years since MWL launched on May 15, 2024! We’ve been actively engaged this year across a range of matters – from an intense water rights trial to regulatory proceedings and advisory services – reflecting the continued complexity of California water law and the demands facing clients.
Recently we submitted an amicus curiae brief in a significant case now pending before the California Supreme Court: Bring Back the Kern v. City of Bakersfield (2025) 110 Cal.App.5th 322, review granted, S290840. The case centers on long-standing water rights and diversions and how those rights and needs intersect with the environment and fisheries. Petitioners are environmental groups arguing that decades of dewatering a historically flowing riverbed have harmed public trust resources, while respondents contend that established water rights and flood control operations govern the system and provide protections. The Court’s decision could clarify how the public trust doctrine applies to fully appropriated and heavily managed river systems in California.
Looking ahead, MWL is developing a new service that we expect to announce later this year, so stay tuned! While details are still under wraps, the goal is to provide practical, forward-looking support tailored toward dispute resolution.
